1. INTRODUCTION
The purpose of this document is to regulate the GENERAL CONTRACTING CONDITIONS of the reservation services (hereinafter the services) of HOTELES SURNORTE S.L.U. (hereinafter VISTAMAR), with registered office at CALLE DON QUIJOTE 22, 38390 Santa Úrsula/Tenerife, telephone 0034 922 33 79 57. Registered in the Mercantile Registry of Santa Cruz de Tenerife, Volume 1885, Page 155 of the General Section, Page TF 21328, 1st Inscription; CIF B38554184. The term “User” is used here to refer to all individuals and/or entities that for any reason register at www.tenerifevista.com or use its services.
2. USE OF THE ON-LINE BOOKING SERVICES OF “VISTAMAR” TOURIST APARTMENTS
2.1. The purpose of the online reservation services is to reserve VISTAMAR. The use of these services will imply the full and unreserved acceptance, and the validity, of each and every one of the Contract Conditions, which will be considered automatically incorporated into the contract signed with VISTAMAR, without the need for its written transcription in the same of these GENERAL CONDITIONS. The room prices include the IGIC and other taxes, if any.
2.2. Recruitment procedure: During the process of making the reservation, the user must fill in some essential information to carry it out. The user guarantees that they are over eighteen (18) years of age and that the information they provide is true, exact, complete and up-to-date. Once the complete data of a credit card has been transmitted, the user will receive an email with the confirmation. However, reduced rates do require a deposit. This email serves as proof of your reservation. For reservations without deposit (standard price) VISTAMAR can block the amount of the first night to your card.
2.3. Security and protection for buyers: Our online reservation system complies with the SLL protocols, and the 3DSecure system is used in our payment gateway, redirecting the data to secure servers without VISTAMAR being able to access or store it.
In order for a reservation to be considered confirmed, it is an ESSENTIAL requirement to have transmitted the data of a credit card. At VISTAMAR we work so that errors do not occur during the online reservation process, but if the user detects an error during this process, they can contact us by email at info@tenerifevista.com
2.4. The cost of the accommodation includes the use of the apartment, linen (cloth sheets and towels), final cleaning, use of common areas and Wi-Fi connection.
3. REGISTRATION OF ENTRY AND TIME OF DEPARTURE
3.1 The check-in will take place from 1:00 p.m. to 6:00 p.m. on the day of arrival. In the event that the user does not show up at the apartment at that time, it will be understood, without prior notice or negotiation conditions, the reservation as canceled and VISTAMAR will freely dispose of the apartments involved in the reservation.
To check-in, all reservation beneficiaries over the age of 18 must present a photo ID, driver’s license or passport. Citizens from outside the European Union will only be able to check in with their passport. (Organic Law 4/2015, of March 30, for the protection of citizen security and Order INT/502/2003 of February 21 and Order INT/1922/2003 of July 3)
3.2 The user agrees to leave the apartment before 11:00 a.m. on the day of departure.
4. MODIFICATION OR CANCELLATION OF THE ONLINE RESERVATION
4.1 Any cancellation or modification in an ONLINE reservation (number of places, date of entry…) must always be requested through the link in your confirmation received by email. Any change in the category of the apartment must be requested by email at info@tenerifevista.com and at VISTAMAR we will always try to comply with your request.
If the user cancels their reservation, the cancellation may result in cancellation fees, which cover the expenses and damages incurred due to the non-occupancy of the reserved places and canceled prior to the expected date of arrival, as well as the expenses originated by contracts or purchase of supplies for the installation. Cancellation fees are always automatically charged to the card provided by the user.
4.2 The expenses will be charged in the following terms and conditions:
-You can cancel for free up to 5 days before the arrival date (standard price). If you cancel between 4 and 1 day before arrival, VISTAMAR will automatically charge the price of the first night as a cancellation fee. But the total price of the reservation will be paid if it is canceled the same day of arrival or if you do not arrive at the VISTAMAR without prior notice or if it is a late arrival or if it is an early departure.
-Other rates with a reduced price have other stricter cancellation rules that are listed in the online reservation process.
– Return and reimbursement: The refund of the amount of the reservation, after discounting the cancellation costs, if any, will be made within a maximum period of 30 days (Article 14 of Decree 17/2011 of September 8). This refund will be made by the same payment method that the user used when making the reservation.
5. CONDITIONS OF USE OF THE ESTABLISHMENT
5.1 Smoking is NOT allowed in the apartments or in common areas.
5.2 Pets are NOT allowed.
5.3 Parties such as bachelor parties are NOT accepted
5.4 The use of the complex is exclusively for persons registered at the reception. VISTAMAR may require a supplement for any additional person or may also deny access to any unregistered third party.
5.5 It is forbidden to hang any type of VISTAMAR garment (towels, sheets, clothing…) in full sun to avoid damage to the color of the garment.
5.6 The client must respect the night rest at VISTAMAR between 11 pm and 7 am to avoid any disturbance to other guests.
5.7 You can request a cot, a baby chair, board and iron or other necessary objects at no additional cost (all subject to availability).
5.8 VISTARMAR offers a change of towels from a minimum stay of 5 nights and a change of bed linen with a quick cleaning of the apartment from a minimum stay of 7 nights.
5.9 VISTAMAR will automatically charge the client’s card for the loss or breakage of any object that is the property of VISTAMAR. The user can request an invoice for that expense.
6. PERSONAL DATA
During the online reservation process we have requested a series of personal data from the user in order to provide the requested service and/or bill it.
The data provided will be kept as long as the commercial relationship is maintained or during the years necessary to comply with legal obligations (articles 66 to 70 of the General Tax Law). The data requested is necessary, so that if you do not provide it, the provision of the required service will not be possible. The data will not be transferred to third parties except in cases where there is a legal obligation.
You have the right to obtain confirmation as to whether VISTAMAR (Hoteles Surnorte S.L.U.) is processing your personal data, therefore you have the right to access your personal data, rectify inaccurate data or request its deletion when the data is no longer necessary, to the limitation of its treatment, or to oppose the treatment, as well as the right of data portability. The data provided will be kept as long as the commercial relationship is maintained or during the years necessary to comply with legal obligations (articles 66 to 70 of the General Tax Law). The data that is requested is necessary, so that if it is not provided it will not be possible to provide the required service. The data will not be transferred to third parties except in cases where there is a legal obligation.
The user can consult our Privacy Policy where all aspects related to their personal data are explained: our identification, type of data we collect, for what purpose we do it, the treatment we give them, data transfers and conservation of the same, the exercise of user rights and the security measures that we apply.
During the making of the reservation, data related to browsing the website necessary for its proper functioning can be collected (review the Cookies Policy for more details).
You can request the exercise of Rights related to your personal data by sending a letter to Hoteles Surnorte S.L.U or by sending an email to info@tenerifevista.com, attaching a photocopy of your identification document (ID card or passport).
